Access to information of public importance
Requests for access to information of public importance, that are related to or originated in relation to the work of the Directorate for Measures and Precious Metals, can be submitted in written form in the following manners: via postal service; delivered directly to the area for submitting requests, as well as in verbal form on the record at the address: Directorate for Measures and Precious Metals Mike Alasa 14 11000 Belgrade from Monday to Friday between 7,30 and 15,30, or via email to the email address: This email address is being protected from spambots. Requests for access to information of public importance can be submitted by anyone.
A request must consist of: the name of the institution, name, surname, and address of the applicant, telephone number, or another form of contact information, as well as a thoroughly detailed description of needed information. A request may contain other details that may facilitate the search for needed information. A request may also contain reasons why the information is needed, but that is not required.
If the request does not contain the name of the institution, name, surname, and address of the applicant, as well as a detailed description of needed information, authorized personnel is required to instruct the applicant on how to properly complete the request or provide the manual on how to complete it, without any fee.
If the applicant does not complete the form in an estimated time of 15 days from receiving the instructions on how to complete the form so that it can be processed, DMDM concludes to reject the request as incomplete.
Directorate for Measures and Precious Metals informs the applicant about the status of the information and if it is otherwise available - issues the document that contains the required information, or it may issue or refer to a copy of that document. If it is not able to do so in an estimated period, it informs the applicant within 7 days about determining the subsequent period that can not be longer than 40 days from the day of receiving the request. If the request refers to information that is of significant importance in protecting the life or freedom of an individual, is of significance in either endangering or protecting the health of the population, as well as protecting the environment, the time to process the request is 48 hours.
The Directorate notifies the applicant that they will issue the information as well as details of time, place, methods of issuing the information, and the cost of the fees of issuing the document to the applicant. If the applicant does not have the technical means to make a copy of the document, they will inform the applicant about the possibility of using equipment in the Directorate for the copy.
Accessing the document with the required information is free of charge and it can be done in the offices of the directorate.
The applicant has the obligation to pay the necessary costs of issuing the copy of the document with the required information and in the case of the referral to the document, the cost of referral as well. The prices of those costs are determined by the Government.
If a person is unable to inspect the document containing the required information without an escort, they will be assisted to do so with the help of an escort.
If the request is met, DMDM will not issue a special determination, but form an official note.
If the Directorate refuses to entirely or partially inform the applicant if they own the information, or to issue the document with the required information (or the copy of that document) it has the obligation to make a written decision on why the request was rejected. The applicant can file a complaint against the decision of the Directorate to the Commissioner for information of public importance, and personal data protection (Commissioner), as well as in case the decision was not brought or if the Directorate determined the request as incomplete. The applicant can initiate an administrative dispute against the decision of the directorate or the conclusion of the commissioner.
